VietnamWorks may face a lawsuit for the removal of a job ad
LawSoft Joint Stock Company, a client of VietnamWorks, the most well known and professional human resource solution provider, has threatened to take legal proceedings against VietnamWorks, because the human resource service provider removed a job advertisement of LawSoft from its website.
Several days ago, a strange advertisement appeared on VietnamWorks’ website. The ad read that LawSoft was seeking suitable candidates to work as an assistant to the director of the company who will be in charge of personnel issues and interior affairs. The candidates must have some requirements. They need to have good memory and have wide social knowledge, and especially, they can drink at least seven bottles of beer and wine.
However, the advertisement piece which has been described as “funny” was later removed.
In the document sent to VietnamWorks LawSoft has requested the human resource service provider repost the advertisement or it will bring the case to the HCM City’s court and claim damages of 1000 dong. LawSoft believes that VietnamWorks suddenly removing the advertisement without an agreement between LawSoft and VietnamWorks has broken the contract signed between the two parties.
LawSoft has affirmed that VietnamWorks must post the advertisement prior to December 19, 2010.
Bui Tuong Vu, Director of LawSoft, said that the company does not aim to get compensation if it sues VietnamWorks, because 1000 dong is very small. However, LawSoft wants to prove that VietnamWorks has broken commitments.
LawSoft is a regular and loyal client of VietnamWorks and the two sides have been cooperating for six months. LawSoft has paid service fees to VietnamWorks 19 times. Under the contract, LawSoft will have to pay $79 for each time the advertisement piece is published, and for 30 days
The advertisement was edited by Vu himself and it first appeared on VietnamWorks’ website on December 12. After that, it was removed from the website on December 16. By afternoon of December 15, 86 candidates had applied for the post, and the employer is shortlisting the candidates.
Right after the news was removed, in the afternoon of December 16, LawSoft and VietnamWorks had a meeting to discuss the problem. Explaining its decision, VietnamWorks said that the advertisement piece is unprofessional and asks the company to edit the piece, or it will stop publishing the piece and pay back the fee. VietnamWorks said that if the piece with the same content continues appearing on the website, VietnamWorks will lose its prestige.
However, Bui Tuong Vu believes that VietnamWorks cannot impose the regulations on ad content for LawSoft. “Every employer has his own method. Meanwhile, LawSoft does not want to follow a normal way that is used by many other enterprises,” he said. “We did not violate the law and our advertisement is not contrary to the national habits and customs”.
In fact, the advertisement and its strange requirements has caught the special attention of many people and candidates.
Explaining the odd advertisement, a, representative of LawSoft said that it is very difficult and time consuming to find suitable people among hundreds of applications. LawSoft wants to find people who can understand and fit the culture and the working environment of the company. LawSoft wants to break the old conventions and make the advertisement friendly to candidates.
Meanwhile, at VietnamWorks, Ha Hue Chi, Marketing Director of VietnamWorks, said that the company has received feedback from readers that the advertisement’s content does not use professional language, and that the piece uses the language of teenagers. Therefore, the managers of the company have decided to remove the ad and renegotiate with the partner. It is estimated that 5000 people had read the piece before it was removed from the website.
