Higher fines ahead for land use violators
Penalties for administrative violation of land use regulations would reach up to VND300 million (US$17,240), under a draft regulation being considered by the Ministry of Natural Resource and Environment.
The draft, which would replace Decree No 182/2004/ND-CP, is due to be submitted to the Government for consideration later this month.
Decree No 182/2004/ND-CP set forth administrative penalties ranging from VND100,000 to VND30 million for violations of land laws, including using land for the wrong purpose or transferring land illegally.
If the draft is approved, individuals and organisations that use land illegally that has been allocated for construction projects in urban centres and industrial, hi-tech and export processing zones would be fined up to VND300 million.
Violators who on encroach land, both farm and non-farm, would face sanctions of VND30-100 million, and up to VND400 million if the transgressed land belongs to urban areas, famous landscape or areas protected by the State.
Individuals and organisations that pollute land or render land unusable for its primary purposes would be fined VND100-300 million.
Those who deliberately did not allocate land in a timely manner, in accordance with land reclamation decisions of responsible authorities, would suffer fines of VND500,000-VND5 million.
Fines for violators related land unregister or wrong register and transfer will be VND500,000 – 2 million.
Land transfer, lease and inheritance; using land for guarantee or capital contribution in urban areas will also have to sanction a fine of VND2-10 million if it does not meet required administrative procedures. The rate for such kind of violation in rural areas will be VND1-1.5 million.
To prevent land from sitting unused, the draft would also regulate that investors who don’t use land for 12 consecutive months after it has been allocated, or whose projects are 24 months or more behind schedule, without approval from relevant authorities, would be fined VND2-10 million.
As in all such violations, in addition to fines, violators would also have to restore land to the condition it was in before it was allocated.
