DCL: Information on the appellate court On March 27, 2023, the High People's Court in Hanoi opened an appellate trial, considering the appeals of the defendants, civil defendants, and related persons in the loss of USD3.8 million that occurred at Cuu Long Pharmaceutical Joint Stock Company.
The Procuracy believes that for damage caused by individuals performing tasks assigned by the juridical person, the juridical person must compensate. The Company has the right to request the defendants and related persons to return the money, win the right to sue for the Company with another civil lawsuit.
After considering, the Appellate Tribunal said that through the direction of Mr. Luong Van Hoa (former General Director of DCL), the defendants had accounted for the decrease in cost price of US$3.8 million for the Company's operations, giving money in business activities. The dividend payment is based on the Company's business activities. Therefore, the appellate court rejected the appeal of Cuu Long Pharmaceutical Joint Stock Company, the company still had to compensate the amount according to the first-instance judgment.
