Firms fail to make use of trade defence measures

Trade defence measures have yet to be frequently implemented in Viet Nam even though such mechanisms are useful and effective tools for enterprises to protect themselves in the globally integrated market, a conference heard on Wednesday in Ha Noi.

Head of the Viet Nam Chamber of Commerce and Industry's Legal Department Tran Huu Huynh blamed the unsatisfactory results on the inadequate understanding of the measures' effectiveness among businesses. He also claimed that businesses did not have enough access to information or the skills necessary to lodge a complaint.

"Enterprises and associations have also not paid enough attention to the local market and the protection of their market concerning imported goods," Huynh said.

The Viet Nam Association of Small- and Medium-sized Enterprises Chairman Cao Si Kiem agreed. He said that there were inadequate efforts in supporting the enterprises to use trade remedies and protect their position in the domestic market by utilising capital, technology, product quality, management and business strategies and distribution networks.

"Without State support, it is a challenge for Vietnamese enterprises to use trade defences instruments," said Viglacera Float Glass Corp's Legal Division Director, Vu Hai Anh.

Last year, Viglacera sent an application to the Viet Nam Competition Authority requesting that the officials impose safeguard measures on imported float glass. After a year of investigation, Viglacera was disappointed with the mediation of the issue. Anh petitioned the authorities to complete the procedures of investigation. She also asked the officials to increase consulting services for enterprises by offering periodic training courses and direct consultation sessions with similar cases.

In order to increase the implementation of trade defence mechanisms, Huynh said they needed to increases businesses' knowledge about certain mechanisms and resources and establish mechanisms for providing necessary information to enterprises so that they might lodge a complaint.

Vietnamese firms were entitled to request investigations into imports which have been reported to bring unhealthy competition and implement trade remedy measures to protect the legitimate rights and interests of businesses in the domestic market, said Deputy Minister of Industry and Trade Le Danh Vinh.
