Publicity of audit results
Under Decree No 90/2008/ND-CP dated August 18, the State Audit must announce annual audit reports and report on the results of audit cases except those involving State or professional secrets. The decree is designed at achieving transparency in State audit activities.
Suspension of automatic exports
To remove barriers for enterprises exporting iron and steel, on August 22, the Ministry of Industry and Trade issued Decision 30/2008/QD-BCT on suspending the automatic export licensing regime for iron and steel. Exporting enterprises will now not have to get a licence.
Spam mails managed
On August 26, the Government issued Decree No 90/2008/ND-CP dated August 13 on preventing spam mail. This covers e-mails, messages sent to those who do not want to receive or are not obliged to receive.
The decree strictly forbids sending spam mail, cheating, and using software to collect e-addresses without owner’s approval. Advertisement service providers are allowed to send advertising e-mails and advertising messages until the recipients object.
New decree for finance-leasing companies
After Decree No 81/2008/ND-CP on financial companies, the Government has issued Decree No. 95/2008/ND-CP dated August 25 amending two previously issued decrees.
Decree 95/2008/ND-CP confirms that foreign-invested finance leasing companies may be established in a form of a joint venture or a 100 per cent foreign-owned company.
However, as is the same for finance companies, there is a hard requirement that foreign parties in a finance leasing company must have total asset value of US$10 billion. This says "no" to small or medium-size investors to enter Viet Nam’s finance leasing market.
Standard forms for consulting services
By Decision No 1048/QD-BKH dated August 11, the Ministry of Planning and Investment issued a new set of forms for calling for consulting services’ bidding for projects subject to compulsory bidding under the Law on Tender.
